    IN THIS ARTICLE, WONG KIAN JUN LOOKS AT THE CASE OF HARIANTO EFFENDY BIN ZAKARIA & 8 OTHERS V. INDUSTRIAL COURT OF MALAYSIA AND ANOTHER ON THE RIGHT EMPLOYERS HAVE TO IMPOSE DIFFERING PUNISHMENT ON EMPLOYEES WHO HAVE COMMITTED THE SAME MISCONDUCT.

    Differing punishment despite committing the same nature of misconduct

    The Federal Court had in this case upheld the dismissal of the employees (the "Employees") by Bumiputera Commerce Bank Berhad (the "Bank") despite the Bank imposing differing punishment on other employees of the Bank who committed the same misconduct.

    Facts of the case

    All the Employees who were active members of the National Union of Bank Employees ("NUBE") took part in a series of pickets in the month of October 2003. On 21 October 2003, the picketers, including the Employees, commenced the picket at approximately 12.30 p.m. outside the Bank's branch on Jalan Tun Perak. Thereafter at approximately 1.25 p.m., the picketers moved to the side entrance of the Bank holding placards and balloons and barged through the side entrance despite attempts by the security personnel of the Bank preventing them from entering. The picketers proceeded to the lobby and entered the banking hall, disrupting the operations of the Bank.

    Are Inter-spousal Gifts "Matrimonial Assets"?

    Two issues in family law are pertinent when one spouse gives the other a gift during their marriage. First, when these spouses divorce, are such gifts subject to the Court's power of division over matrimonial assets? Section 112 of the Women's Charter provides that "(t)he court shall have power, when granting or subsequent to the grant of a judgment of divorce, ... to order the division between the parties of any matrimonial asset ... between the parties ... in such proportions as the court thinks just and equitable."[1] Second, if these gifts remain matrimonial assets available for division, how should such gifted assets be divided between the spouses?

    Statutory Definition of "Matrimonial Asset"

    Section 112(10) of the Women's Charter provides that all assets acquired by one or both parties during marriage are matrimonial assets. These assets constitute the bulk of matrimonial assets in most cases. An asset acquired before marriage or by gift is not a matrimonial asset unless the other spouse or both spouses have substantially improved it during the marriage, or alternatively, it is a matrimonial home. Assets acquired before marriage are also matrimonial assets if used by the family for shelter or transportation or for household, education, recreational, social or aesthetic purposes. Is property acquired by one spouse during marriage and given to the other considered a "gift" within the meaning of s. 112(10) and hence excluded from the pool of divisible assets?

    INFORMATION TECHNOLOGY AND THE COMMON LAW*

    THE HON JUSTICE STEPHEN GAGELER

    The Annual Richardson Memorial Oration is held each year in honour of the late Professor Jack Richardson AO, the Commonwealth's first Ombudsman.

    The Oration is organised by the ACT Law Society and ACLA, with the generous support of Clayton Utz.

    Jack Richardson left the Australian National University Law School to become the first Commonwealth Ombudsman the year I started there as a student. We met only late in his life and then all too briefly. But like all who attended that great Law School during those first few decades of its existence, I am a direct beneficiary of his determination to establish it as a first class national law institution and of his skill in achieving that goal. It is an honour to give this oration in his memory.

    My topic lies at the intersection of legal practice and legal thinking: it is concerned with the impact of information technology on the judicial development of the law within a common law system. I should start by explaining what I mean when I refer to a common law system, and what I mean when I refer to the judicial development of the law within a common law system.
