    ABSTRACT

    Maxims are legal principles that give a bird’s eye view of the content of the law, and not as jurisprudence, the sources of the law. Reflective of a consolidated reading of fiqh by great jurists, it is a handy tool for lawyers and judges who need it to expand the grasp and understanding of content and objective of the law. Despite the availability of several works on inheritance law, there is rarity in works that deal with maxims and inheritance as their theme which this work attempts to explore. The Maxim “Treatment to counter (evil) objective” (Al-Mu’ãmalatu bi naqĩḠal-Maqṣũd) is one of the principles of law that embodies Sharia’s policy of blocking means to evil and prohibiting evasion of its provisions. This paper aims at studying the maxim under the auspices of the inheritance law and points out its particulars that relate to the law of succession.

    It is common for an Advocate and Solicitor practising in the Intellectual Property (“IP”) profession to perform a role as a registered patent, trade mark and/ or industrial design agent (“IP Agent”) within his full-time practice in a law firm. Following this common practice, IP Agents who are also lawyers are often entrusted by clients to represent them in contentious disputes relating to patent, trade mark or industrial designs.
