    ABSTRACT

    Forex trading is one of the many issues that is dealt with under Islamic Banking law. Foreign exchange trading or forex at a point was known to be something that people did when they were travelling overseas. They would trade their home countries' currency for another and experience the present currency exchange rate. Nowadays, traders speculate on the varying values of currencies involving two countries. It is carried out for profit and sport. The dispute on paper money was settled during the third session of the OIC Islamic Fiqh Academy in October 1986. In Resolution No. 21, it was stated that paper money had the same effect as gold and silver, and thus all rulings for gold and silver shall be applicable on the paper money. This in effect made paper money a ribawi item, whereby currency exchange can only be done on the spot. However, the discussion on Bay' al-Sarf, ie, contract of exchange of money for money, had been delayed due to lack of detailed study. This paper is going to discuss the current practice of Malaysian Islamic Banks on the currency exchange which is in line with the principles of Shariah Law.

    (1) Introduction

    1. It is a real pleasure to have been invited to celebrate the 800th anniversary of the sealing of Magna Carta with you this evening. As you may know, I am chairman of the Magna Carta Trust, a position held by all Masters of the Rolls since the Trust was established in 1956. As you can imagine my term of office has been a little busier than that of my illustrious predecessors.[1]

    2. One of the aims of the Trust is to 'perpetuate the principles of Magna Carta'.[2] Magna Carta is a curious hotch-potch of a document. Many of its provisions cannot by any stretch of the imagination be described as principles. They include detailed measures of an intensely practical nature which reflect the economic and social conditions of the early 13th century. Some of them were aimed at resolving grievances that King John's barons had at the time; grievances that were not only directed at him, but were a reaction to the rule of the Angevins more generally.

    Abstract

    Where legal professional privilege attaches to communication between legal adviser and a client, the client is entitled to object to any third party seeing the communication for any purpose unless, (i) the client has agreed or waived his right, (ii) the advice is sought and given for a nefarious purpose, in furtherance of an illegal purpose. The brief article seeks to lay down the circumstances and the rationale where legal professional privilege does not apply and at the same time discussing the scope of the exceptions.

    Nature Of Legal Professional Privilege

    Two types of communications may be subject to legal professional privilege. Firstly, confidential communications between client and legal adviser for the purpose of obtaining and giving legal advice may be subject to legal advice privilege. Essentially legal advice privilege arises out of a relationship of confidence between lawyer and client. Unless the communication or document for which privilege is sought is a confidential one, there can be no question of legal advice privilege arising, the confidential character of the communication or document is not by itself enough to enable privilege to be claimed but is an essential requirements.[4]
