    Abstrak

    Pemeriksaan autopsi terhadap mayat merupakan proses penting bagi koroner yang menjalankan inkues berdasarkan Kanun Prosedur Jenayah. Namun demikian terdapat ketidakseragaman dalam amalan dan praktis prosedur inkues sehingga menimbulkan keraguan umum terutamanya pihak ahli keluarga si mati. Penulisan ini merungkai cabaran dan proses perundangan sebenar inkues serta autopsi. Ianya menegaskan bahawa terdapat neksus 'medico-legal' forensik yang memerlukan pemahaman umum.

    Kata kunci: Inkues koroner, post-mortem, prosedur siasatan kematian.

     

    Pendahuluan

    Prosedur bagi kes siasatan kematian di negara ini terkandung dalam Kanun Prosedur Jenayah (“KPJ”)[1] dikendalikan oleh majistret (kini bertaraf hakim kanan Mahkamah Sesyen) mengendalikan inkuiri kematian (‘inkues”) dengan mengambil alih kuasa dan peranan seorang koroner.[2] Inkues menyiasat sebab kematian secara menyeluruh yang tidak terhad kepada penentuan melalui pemeriksaan klinikal semata-mata.[3] Inkues merupakan satu prosiding khas di bawah Bahagian VIII, Bab XXXII KPJ. Ia memberikan perincian prosedur siasatan termasuk aspek peranan pihak-pihak terlibat iaitu pihak polis, pegawai perubatan kerajaan termasuk kuasa Pendakwa Raya.

    CROSS-BORDER INSOLVENCY ISSUES IN ASIA*

    Introduction

    Practitioners in any cross-border insolvency case in Asia will tell you that the laws in a number of countries in Asia lag behind the commercial and practical realities. In some cases, others will suggest that there are no or no sufficient laws pertaining to cross-border insolvency to address commercial and business concerns.

    Local laws in Asia have to a large extent not kept pace with the fast expanding global trades and investments and are usually ill-equipped to deal with insolvency cases of a cross-border nature. This potentially leads to inconsistent administration practices and procedures and laws, which hinder the efficient or fair administration of insolvencies, or hamper any prospect of rehabilitation of the company.

    Many countries in Asia currently do not have sufficient laws to deal with the issue of co-operation in insolvency cases that have cross-border or international elements. The principle of “territoriality” often dominates, and the insolvency of a group company which covers several countries in Asia, will be resolved by reference to the specific law of the country that a particular entity is incorporated or where its assets are located.
