    INTRODUCTION

    In the field of motor insurance, the Malaysian Parliament has enacted provisions under Part IV of the Road Transport Act 1987 to make it mandatory for motor vehicle users to have in force a policy of insurance in respect of the risks of bodily injury and death to third parties.

    This article examines the current position of the law on compulsory third party insurance and highlights the legal challenges that courts are confronted with in interpreting legislative provisions to determine the scope of their applications when tasked to resolve disputes between claimants for guaranteed compensation under the scheme and insurers seeking to rely on these provisions to avoid liability. It focuses on the rights of passengers under the mandatory insurance scheme and the duty of the insurer to satisfy the judgment sum under section 96 of the Road Transport Act 1987.

    For some time there has been considerable informal discussion and speculation in the profession as to what ethical constraints are imposed upon a practitioner in instances where joint instructions are obtained from clients, typically husband and wife or partners, to prepare mirror wills on behalf of both clients, ie, wills which in effect reflect in reverse the same provisions. After the completion of the retainer, that is, the signing of the will, and usually holding those wills in safe custody on the clients' behalf, some time later the practitioner may be approached by one of the clients with instructions to prepare a new will, changing significantly the provisions of the mirror will held in safe custody. This in turn triggers consideration of a number of issues - in particular, an ongoing duty of loyalty after termination of the retainer.

    They say that familiarity breeds contempt. After Jokeen Cyril Fernandez came into my life I say - only when that person is a pretender to character, or accomplishment. The more one knows such poseurs, the shallower they are revealed to be. This is why love at first sight is cured by a second look.

    Cyril, however, was integrity personified. Physically he stood at just above five feet but the longer I knew him the more he towered in my estimation. I first met him when I was in my midteens in 1948. I then lived in the Government quarters in Peel Avenue, Kuala Lumpur. Those houses have long since been demolished to make way for low-cost flats. The Peel Road Convent still stands a stone's throw from where our houses once stood. Cyril had just arrived from India to take up residence with his sister whose husband Mr Lawrence was also in Government service.
