    Pengenalan

    Pengkomputeran awan (cloud computing) merupakan pembangunan teknologi komputer berasaskan Internet yang merupakan pusat data yang sangat berkuasa.[1] Ia merupakan suatu proses dimana pengguna menggunakan Internet sebagai tempat untuk menyimpan atau storan segala data peribadi seperti dokumen, gambar, video dan sebagainya yang sebahagian besarnya merupakan bahan-bahan berhak cipta. Pengkomputeran awan akan memuat alih data-data milik pengguna laman sesawang dan kemudiannya data yang disimpan tersebut boleh dicapai di mana-mana sahaja asalkan adanya kemudahan Internet di kawasan tersebut.[2] Pengkomputeran awan ini hakikatnya adalah sangat kompleks dan suatu bidang yang bergerak terlalu pantas di dalam undang-undang.[3] Pengkomputeran awan membolehkan seseorang berkongsi data, bekerjasama dan berhubung dengan pihak-pihak di seluruh dunia yang kita tidak mampu bayangkan sedekad yang lalu.[4] Ia boleh digunakan secara individu atau dalam kelompok yang ramai.     CONTEMPORARY TRENDS IN THE RESOLUTION OF INTERNATIONAL
    COMMERCIAL AND FINANCIAL DISPUTES*

    It is a pleasure to give the 2016 ICCL lecture. The Institute has done excellent work in promoting the study of commercial law at Durham Law School, and it is a privilege to follow earlier annual ICCL lectures given by Lord Hodge and Sir Ross Cranston.

    I spent a good part of my childhood, literally as well as metaphorically, in the shadow of Durham's great cathedral. The time of its completion in the 12th century was a period of strong economic growth. In dealing with the disputes that inevitably arise in trade, the merchants of the time had to cope with problems that are still with us. How do you develop portable rules that will work in different places? How do you input practical expertise so that disputes are resolved in accordance with commercial expectations? What are the underlying values which the system should reflect?

    It is interesting to note that from a very different perspective, and in the context of a discussion on the future of arbitration law, Professor Shen Wei has recently analysed the medieval contribution in these respects in the form of the lex mercatoria and the merchant courts, and asked how they chime in our very different global environment.[1]

    THE ROLE OF THE NATIONAL COURTS IN THE RECOGNITION AND
    ENFORCEMENT OF INTERNATIONAL ARBITRAL AWARDS IN MALAYSIA

    Abstract

    An arbitral award is ideally a final determination of the rights of the parties, which is supposed to bring an end to the dispute and resolve issues. The only recourse under most arbitral laws against arbitral awards are provisions for the setting aside of an arbitral award. Parties who are dissatisfied with an arbitral decision can apply to the courts where the seat of arbitration is located in order for the court to have a supervisory role in the arbitral process. The aim of this paper is to examine the role of the national courts in Malaysia in the recognition and enforcement of international arbitral awards. The paper examines the grounds on which the losing party may rely on in setting aside the enforcement of the international arbitral award. The methodology adopted in this paper is a legal library based research or doctrinal research focusing mainly on primary and secondary sources. On a final note, the paper concludes that the Malaysian Arbitration Act 2005 is similar to the UNCITRAL Model Law when it comes to the grounds to set aside the recognition and enforcement of international arbitration awards.
