    PENGECUALIAN LIABILITI DARI PERSPEKTIF HUKUM SYARA'

    Abstrak

    Kes Bolam v. Friern Hospital Management Committee telah sejak sekian lama menjadi kayu ukur dalam kes-kes kecuaian perubatan di Malaysia. Namun, selepas keputusan Mahkamah Persekutuan dalam kes Foo Fio Na v. Dr Foo Sook Mun & Anor pada tahun 2007, berlaku perubahan dan mahkamah di Malaysia kini tidak lagi mengutamakan ujian Bolam dalam kes-kes kecuaian perubatan kerana ujian Bolam dilihat sebagai terlalu melindungi profesyen perubatan dan bersifat paternalistik. Perubahan ini berlaku turut disebabkan dari perkembangan yang berlaku secara global berkenaan doktrin izin bermaklumat (informed consent) yang dipengaruhi oleh konsep autonomi pesakit. Doktrin izin bermaklumat ini bertujuan untuk melindungi hak pesakit untuk mendapat maklumat-maklumat yang sepatutnya berkenaan risiko perubatan sebelum memberi keizinan kepada sebarang kaedah rawatan dikenakan. Artikel ini menganalisis doktrin izin bermaklumat dari perspektif prinsip syariah atau hukum syara'. Menurut prinsip syariah, pelaksanaan doktrin izin bermaklumat adalah berpaksikan akad atau kontrak yang dipersetujui oleh doktor dan pesakit yang berasaskan kepada prinsip keridhaan dan kerelaan yang disebut dalam al-Baqarah, ayat 282. Ianya turut berasaskan kaedah fiqh "al-rida bi al-shay' rida bima yatawallad minh" yang bermaksud "rela dengan sesuatu bermakna rela dengan apa yang berlaku hasil daripada sesuatu". Artikel ini menganalisis isu liabiliti doktor dalam kes kecuaian perubatan menurut perspektif prinsip syariah. Ianya juga meninjau sejauh manakah prinsip syariah itu melindungi doktor sekiranya kecuaian tersebut berlaku secara tidak sengaja mahupun berlaku disebabkan faktor-faktor yang tidak dapat dielakkan serta berada di luar kawalan doktor.

    Pengenalan

    Pemberi Perkhidmatan Internet ('ISP') merupakan sebuah entiti komersil yang membenarkan seseorang individu untuk suatu capaian (akses) menerusi komputer kepada Internet.[1] ISP menurut s. 43B Akta Hakcipta 1987 adalah seseorang yang memberikan perkhidmatan berhubung dengan, atau mengadakan penyambungan bagi, capaian, pemancaran atau penghalaan data. Isu hak kebebasan bersuara dan ISP timbul apabila ia melibatkan pertembungan antara pematuhan undang-undang hak cipta bagi melindungi pemunya hak cipta dan peranannya dalam menyediakan capaian kepada para pengguna. Perlindungan kepada ISP di bawah kebebasan bersuara terfokus kepada perkara berkaitan kebebasan berkomunikasi oleh pengguna. Dalam kata lain, perlindungan kepada hak kebebasan bersuara itu melindungi cara berkomunikasi di mana pengawalan dibuat oleh entiti tertentu sama ada orang sebenar atau pemilik rangkaian jalur lebar.[2]

    ISP Dalam Isu Hak Cipta Dan Kebebasan Bersuara

    ISP berperanan dalam menentukan arah kebebasan bersuara di Internet. Pengetahuan perlu sampai ke pihak ISP berkenaan wujudnya aktiviti pelanggaran hak cipta sebelum ISP berhak untuk mengambil sesuatu tindakan. Isu-isu kebebasan bersuara oleh pengguna dalam menggunakan suatu karya berhak cipta dan peranan ISP dapat dilihat dalam perkara-perkara mengenai penamatan akaun serta pengawalan capaian pengguna, pemberitahuan untuk melumpuhkan capaian dan memperlahankan kelajuan Internet.
