    N THIS ARTICLE, KHOR MEYVEN DISCUSSES THE FEDERAL COURT'S CLARIFICATION OF THE STANDARD OF PROOF FOR FRAUD IN CIVIL PROCEEDINGS.

    Introduction

    The standard of proof denotes the quantum or nature of evidence that a litigant has to adduce to convince a Judge that a fact exists.

    In civil proceedings, the standard of proof is on a balance of probabilities, that is, whether an allegation is more probable than not. However, where there is an allegation of fraud in civil proceedings, the standard of proof in criminal cases, namely, beyond reasonable doubt, has been applied by our Courts. This standard is a high degree of probability although it need not reach certainty. However, in some cases our Courts have also applied the standard of balance of probabilities.

    Pendahuluan

    Penderafan dokumen kontrak merupakan satu kemahiran yang perlu dimiliki dan dikuasai oleh seseorang yang ingin berkecimpung dalam bidang guaman. Penderafan ini melibatkan beberapa peringkat dan memerlukan penelitian agar dokumen kontrak tersebut benar-benar menzahirkan kehendak, niat serta mencapai persetujuan pihak-pihak yang berkontrak. Dalam menderaf dokumen kontrak, selain mengenalpasti kehendak pihak-pihak yang berkontrak, hal yang paling utama adalah memastikan bahawa perjanjian yang dibuat selari dengan kehendak perundangan yang terpakai bagi suatu transaksi yang dimaksudkan. Artikel ini akan membincangkan tentang pendefinisian penderafan dokumen serta kaedah penderafan dokumen kontrak. Seterusnya, cabaran dalam penderafan akan turut dibincangkan dan disusuli dengan kesimpulan. Artikel ini tidak akan menangani secara mendalam intipati perundangan mahupun kerangka regulatori di Malaysia, tetapi, tumpuan adalah menjurus kepada kaedah menderaf dokumen kontrak Islam. Aspek regulatori dan perundangan substantif hanya akan dinyatakan menurut kesesuaian perbincangan.

    Penderafan Dokumen Kontrak: Satu Pendefinisian

    Adam memberikan makna 'drafting' menurut kamus 'A Dictionary of Modern Legal Usage secara umum adalah seperti berikut:

    "Drafting is a specific type of legal writing dealing with legislation, instruments, or other legal documents that are to be construed by others. Statutes, rules, regulations, contracts and wills are examples of legal drafting."
