    Abstract

    Pursuant to the reforms made to the Malaysian civil procedure, and with the passing of the new Rules of Court 2012, many changes were introduced which include among others, a more systematic and pro-active system of case management. Although case management has been in existence since before the aforesaid amendment, the new model is expected to be more efficient, effective and practical in supervising parties to get their matters disposed of by the court. This article will explore the rationale of implementing the new case management system and the procedural framework governing the process.

    In 2012, barrister Mark Irving commenced the section on good faith in employment contracts in his text with that pithy summary of the uncertain legal position. He continued:

    "The following description of the law will be completely outdated once the High Court has resolved these issues."[2]

    When Mr Irving appeared before Australia's apex judiciary two years later, for the respondent in Commonwealth Bank of Australia v. Barker,[3] he must have wondered whether those words would prove prophetic.

    Introduction

    Administration of the estate of the deceased in Malaysia is governed by three different backgrounds of administrative bodies. They are the Civil High Court, Small Estates Distribution Section under the Department of Director-General of Lands and Mines, and Public Trust Corporation known as Amanah Raya Berhad ('ARB'). Despite the organisational differences, each and every background mandates the appointment of personal representation. Personal representation is the noblest obligation in the administration of the estate of the deceased as he/she is entrusted with the highest degree of trust and honesty in honouring his legal obligations. The need is well-manifested by the legal requirement to produce a declaration under oath before the extraction of letter of representation is granted by the High Court.
