    Introduction

    His Honour Sir Richard Blackburn OBE was a judge of great erudition and compassion. He was a distinguished academic, a soldier and a judge. He was a gentle man and a gentleman and it was a pleasure to appear before him. It is an honour to be part of the lecture series named after him.

    In the first of the Blackburn Lectures delivered by the Hon Sir Richard Blackburn OBE himself twenty-nine years and three hundred and sixty days ago, the ex-Chief Justice said:

    "I am unrepentant as a supporter of the old-fashioned lecture. ... What a lecture has in common with a performance such as those of Mr Robertson is that if it is any good at all, it must stimulate thought: a lecture which fails to do this is worthless. A lecture is not a means of imparting information; it is, or should be, a means of stimulating the minds of those who already have enough information to make the lecture worthwhile."

    KEY AREAS IN URGENT NEED FOR REVIEW AND REFORMS

    INTRODUCTION

    Industrial relations dispute processing and resolution is a complex exercise of sensibly and sensitively balancing the often competing interests of employers and employees and their respective unions. An efficacious system for processing industrial disputes ensures that the paramount national interests of shaping a vibrant and robust economy while safeguarding social and economic justice for the citizen workforce is achieved in an environment of industrial peace and harmony. There is concern among employers as well as their representative organizations and unions of workmen concerning the ability of the existing statutory system to duly and dutifully perform the role expected of it. There are a whole host of issues on which there are different views as to how they should be resolved. Yet there is an emerging consensus on certain key areas which have to be addressed and reforms to be undertaken as a matter of urgency. Three areas which are of vital concern are firstly, the system and processes for dealing with claims of workmen for the remedy of reinstatement on the grounds that their dismissal was without just cause or excuse; secondly, the issue how awards of the Industrial Court are to be audited and thirdly, the matter of appointments and security of tenure of appointees to the Industrial Court bench.

    STRATA MANAGEMENT IN PENINSULAR MALAYSIA: AN OVERVIEW

    Abstract

    Strata properties law in Malaysia came into existence in 1985 and was governed by the Strata Titles Act 1985 ("STA"). To date, it has gone through various amendments. Nevertheless, it appears that the Act has failed to address the disputes arising from strata management and maintenance. The problem arises when parcel owners tend to look after their own private unit but neglect the common property which belongs to everybody. Consequently, landscaped areas become unattended, stairways become filthy and building lacked proper maintenance. This paper discusses various amendment made; from the first amendment of the STA in 1990, second amendment in 1996, third amendment in 2001 and fourth amendments in 2007 as well the latest amendment in 2013. The objective of this paper is to see whether the amendments to the existing legislations, including the Strata Management Act 2013 are sufficient enough to address the problems which are encountered by the management of strata building in Malaysia. As such this paper will analyse some of the provisions in the Building and Common Property (Maintenance and Management) Act 2007 ("BCPA") and the Strata Management Act 2013 ("SMA"). The research method used in writing up this paper is a qualitative research in which it analysed the relevant statutes, rules, regulations, books, journals, articles, thesis, seminar papers, electronic materials and various newspaper reports. The findings of the research suggest that irrespective of the newly introduced SMA there is a need for more legal improvements in order to create a better regulatory framework for strata management in Malaysia.
