Introduction^[1]

1. It is for me a great pleasure and privilege to deliver this the 4^th BAILII lecture for a number of reasons. I will mention only two. First some 12 or so years ago, I worked very closely with Sir Henry Brooke, then a Lord Justice and chairman of the Trustees of BAILII, to ensure we had in place proper arrangements to provide judgments to BAILII. Second, I am delighted to see how successful that endeavour has been and how much is now available worldwide and for free. The benefit to the legal profession, to the UK and to the rule of law worldwide is immense.

The role of the courts in the development of the law underpinning commerce, finance and industry

2. It is to the rule of law in the context of the international financial markets and to international trade and commerce^[2] that I wish to turn immediately. As is self-evident in this context, the function of the law is to provide the framework within which all societies operate all economic activities from financial markets to manufacturing.

Introduction

The changes to the death penalty for murder were finally announced in Parliament late last year.^[1] As promised earlier by the Law Minister, this followed consultations with law officers, legal practitioners and academics. The new murder provisions^[2] contain no surprises as the mandatory death penalty is to be retained, as previously announced, only for intentional killing under s. 300(a) of the Penal Code. For the three remaining forms of murder under s. 300(b) to s. 300(d) of the Code, namely, intentionally causing a bodily injury the offender knows is likely to cause death, intentionally causing a bodily injury sufficient in the ordinary course of nature to cause death and committing an act the offender knows is so imminently dangerous that it must in all probability cause death, the death penalty is to be imposed at the sole discretion of the trial Judge. He may opt instead to impose life imprisonment with caning.
