    HONOUR KILLING: WHETHER ISLAMIC LAW ALLOWS THIS TYPE OF CRIME?

    ABSTRACT

    Planned murders or premeditated killings of family members, primarily young female relatives, are committed in order to restore the honour of ones family. This is due to the fact that the murder victim is alleged to have brought 'shame' or 'dishonour' to her family by her conduct such as having a relationship with boys that is not approved by her family, having a pre-marital sexual relationship, or even claiming divorce from an abusive husband. This is often reported in the mass media as a crime known as honour killing. This crime may be rare to some parts of the world but in the other, it is a widely spread practice especially in Muslim-based societies. It must be borne in mind that honour killing is unlike the normal crime of murder that we often read about in the newspaper. Honour killing is a distinctive crime of murder based on three reasons; ie, this crime involves planning as its first step - honour killings are planned in advance, often at a family conference or discussion. The perpetrator's family may repeatedly threaten the victim with death if she dishonours her family. Secondly, it revolves around family complicity - honour killings can involve multiple family members in the killing, such as parents, brothers and cousins. Lastly, perpetrators of honour killings often do not have to face negative stigma in their families or communities. Thus, honour killing is a serious crime committed under the name of honour and it is often linked with Islam and Islamic law. It is absurd that this crime is committed by the victim's own family members usually her father or brother. Why does this happen? Does Islam preach that one is allowed to kill their family member to save their honour? Does Islam condone honour killing? Thus, this paper will take a look at the definition of honour killing, the reason behind its occurrence and whether it is a conflict with Islamic law. In the course of scrutinizing the issue, this paper will also discuss on the law in some countries that provide light punishments under the name of honour killing, the law enforced to curb honour killing as well as the ideal punishment for this type of crime under Islamic law.

    Introduction

    The Republic of the Union of Myanmar occupies an area of 676,577 sq km and has a total population of 60 million. Myanmar is situated between the two giants of emerging economies with huge market potential. As a country strategically located and rich in natural resources, Myanmar holds immense potential for direct investment from abroad. A foreign investor who is seeking an opportunity to start an investment in Myanmar may observe the legal framework and administrative practices governing foreign direct investment ("FDI"). Since April 2011, the new government has been reforming and liberalising many areas, ensuring a favourable business environment for potential investors, especially in the fields of production, trading of goods and services, and finance. These reform measures are still undergoing and this article will spotlight the current topical laws on the FDI regime of Myanmar.
