    “I know what this is about. I have been expecting you.” Those were the first words uttered by Reinhard Siekaczek, still in his pyjamas, when six German police officers and a prosecutor knocked on his door early in the morning on November 2006.

    Mr Siekaczek had been enjoying retirement from his job in accounting at Siemens, A.G. However, he had a secret that continued to haunt him even after he retired — his job at Siemens included being the ‘banker’ for a bribery budget of $40-50 million US dollars a year. The telecommunications unit Mr Siekaczek had worked in paid over $800 million in illegal payments from 2001 to 2007.[1]

    Mr Siekaczek knew what he was doing — and what the company wanted him to do — was illegal. The employees who worked around him knew it was illegal. How did this compliance breach happen, and how can you prevent compliance issues from impacting you, your co-workers, and your company?

    Pendahuluan

    1. Perlembagaan Persekutuan Malaysia berdiri bukan hanya sebagai dasar yang memberikan keesahan dan keabsahan kepada setiap undang-undang negara,[1] tetapi lebih utama lagi ia berdiri sebagai dokumen yang merakam kontrak sosial negara ini seperti yang telah dipersetujui dan diakui dalam perundingan menderaf perlembagaan negara.[2] Pemuafakatan yang dicapai dalam rundingan ini menjadi teras kepada penubuhan Malaysia sehingga kini dan sebarang permasalahan berkaitan dengan kedudukan perkara-perkara yang telah dipersetujui dalam kontrak sosial negara ini, wajar dibawa rujuk kepada dokumen yang merakam intisari persetujuan kaum-kaum yang membentuk Malaysia.

    2. Di bawah Perkara 152, Perlembagaan Persekutuan jelas memaktubkan bahawa Bahasa Melayu adalah bahasa kebangsaan. Kedudukan istimewa Bahasa Melayu dalam Perlembagaan Persekutuan turut disokong teguh dengan penggubalan Akta Bahasa Kebangsaan 1963/67,[3] dan Akta Pendidikan 1996,[4] yang secara ringkasnya menyatakan kedudukan tinggi penggunaan Bahasa Melayu dalam hal urusan rasmi dan pendidikan negara. Hal ini adalah sejajar dengan niat kaum-kaum yang membentuk Malaysia agar Bahasa Melayu berdiri utuh sebagai bahasa kebangsaan yang diraikan.
