    THE AUTONOMOUS NATURE OF PARTY AUTONOMY IN ARBITRATION:
    AN INTERROGATION OF PERSPECTIVE

    Abstract

    There is a global increase in the preference for arbitration. This increase has reinforced the growing disaffection for the conventional adversary method of dispute resolution which litigation provides.

    The agreement of parties is recognized as the heart of any arbitration proceeding. It constitutes a contract to which parties refer their disputes which have either arisen or that may arise in future to arbitration. This liberty to consensually execute an arbitration agreement is what is now recognized as the principle of party autonomy.

    Party Autonomy afford parties a right whether in domestic, international commercial arbitration, ad hoc or institutional proceedings to choose and determine their agreed applicable substantive law as well as the procedure to be adopted, these laws and procedure when chosen, regulate their relationship.

    Abstrak

    Keizinan ialah satu elemen asas yang mesti wujud sebelum doktor dibenarkan untuk menjalankan apa-apa rawatan ke atas pesakit. Persoalan yang timbul ialah bagaimanakah doktor hendak mendapatkan keizinan pesakit apabila pesakit sudah hilang keupayaan dan tidak berkeupayaan untuk memberi keizinan? Dalam konteks ini, Arahan Awal Perubatan (Advance Medical Directive) (AMD) yang mengandungi kehendak pesakit tentang pelan perubatan masa depannya boleh memainkan peranan seandainya pesakit sudah hilang keupayaan untuk membuat keputusan tentang tubuh badannya. AMD merupakan satu kaedah penting untuk melindungi hak pesakit apabila pesakit tidak dapat membuat keputusan ketika di ambang kematian. Jika dilihat dari perspektif Syariah, terdapat satu kemestian (wajib) untuk menjaga nyawa setiap individu. Ini adalah kerana kehidupan manusia bukanlah untuk sia-sia. Namun, tanggungjawab untuk memanjangkan nyawa pesakit yang berada di ambang maut tanpa menyembuhkannya turut perlu diambil kira.
