    The Khmer Rouge Trials' Supreme Court Judgement in Case 002/01 and transitional justice in the Asia Pacific

    On 23 November 2016, one of the most significant international criminal trials to date came to an end when the Supreme Court Chamber of the Extraordinary Chambers in the Courts of Cambodia ('ECCC') issued its Judgment in the Appeal of Case 002/01.

    The defendants were Nuon Chea and Khieu Samphan, respectively the former second-in-command and head of state of the Khmer Rouge regime. The case was concerned with crimes committed in the course of forced population transfers, and against officials of the former 'Lon Nol' Khmer Republic regime, after the fall of Phnom Penh on 17 April 1975.

    1.0. Latar Belakang

    Beberapa peruntukan undang-undang keterangan Islam dikesan mula dipakai di Tanah Melayu sejak zaman Kesultanan Melayu Melaka lagi sebagaimana termaktub dalam naskhah bertulis Hukum Kanun Melaka (HKM).[1] Peruntukan-peruntukan mengenai undang-undang keterangan Islam tersebut berupa terjemahan daripada kitab-kitab fiqh karangan ulama' mazhab Syafi'i. Antara prinsip keterangan yang dipakai ialah syahādah, yamīn dan iqrār[2] iaitu prinsip-prinsip yang diluluskan oleh jumhur fuqaha'.

    Setelah kejatuhan Kesultanan Melayu Melaka, negeri-negeri Melayu bekas jajahan takluknya masih terus memakai undang-undang keterangan syariah dan adat di semua mahkamah sebagaimana termaktub dalam Undang-undang Pahang yang sama peruntukannya dengan HKM. Malah sebelum kedatangan pengaruh Inggeris, undang-undang keterangan syariah dan adat dipakai di semua mahkamah di negeri-negeri Melayu kerana semasa itu tidak berlaku pengasingan dalam struktur mahkamah. Undang-undang substantif dan acara, termasuk keterangan, semuanya berasaskan undang-undang Islam dan adat.

    Reply to defence is defined as 'a statement of case served by the plaintiff in a civil action in answer to the defence.'[1] The plaintiff will usually serve a reply to defence. The reason for serving a reply to a statement of defence is because the plaintiff feels that it is necessary to further explain the issues between the parties as pleaded in the statement of claim and statement of defence. Reply to statement of defence is normally filed if the contents of the statement of defence had raised certain issues that required to be answered better.[2]

    Filing a reply to a statement of defence is optional, unlike a statement of claim and statement of defence. Reply to a statement of defence arises in different situations. For instance, a reply will be filed when the statement of defence had raised a point for the first time that requires clarification or explanation from the plaintiff. The plaintiff will file a reply to the statement of defence when some new matter may have arisen as a direct and relevant result of something that has been pleaded in the defence.
