    ABSTRAK

    Malaysia telah memperkenalkan undang-undang domestik berkaitan persaingan pada tahun 2010 yang berkuatkuasa sejak tahun 2012. Pembangunan Undang-Undang Persaingan di Malaysia ialah selaras dengan Pelan Tindakan Ekonomi ASEAN yang ditandatangani pada tahun 2007 yang bertujuan menggalakkan ahli negara-negara ASEAN memperkenalkan Undang-undang Persaingan domestik di negara masing-masing menjelang tahun 2015 bagi menjadikan ASEAN sebagai rantau yang berdaya saing. Hasrat tersebut diteruskan melalui Pelan Tindakan Komuniti Ekonomi ASEAN 2025 yang antaranya memastikan agar Undang-Undang Persaingan dapat dilaksanakan dengan berkesan di kalangan negara anggota ASEAN berpandukan pada garis panduan ASEAN yang telah dipersetujui. Oleh itu, artikel ini bertujuan untuk mengenal pasti mekanisma undang-undang yang digunakan oleh Malaysia bagi tujuan membangunkan Undang-Undang Persaingan domestiknya dan juga menganalisis mekanisma undang-undang yang digunapakai bagi tujuan pelaksanaannya di Malaysia.

    Criminal lawyers practising in the ACT need to be acutely aware of the provisions of Division 5.2 of the Confiscation of Criminal Assets Act 2003...

    The title of this article exaggerates slightly the effect of the provisions of Division 5.2 of the Confiscation of Criminal Assets Act 2003 (COCA), but not unconscionably so.

    In any event, if the result is that criminal law practitioners pay attention, and are made aware of the drastic consequences which can befall the unwary, the exercise of poetic licence will have been justified.

    What is 'statutory forfeiture' of property?

    'Statutory' forfeiture of property — also sometimes called 'automatic' forfeiture — is a confiscation mechanism incorporated into the legislative schemes of a number of Australian jurisdictions, including the ACT, South Australia, Victoria, and the Commonwealth.[1]

    Abstrak

    Keizinan ialah satu elemen asas yang mesti wujud sebelum doktor dibenarkan menjalankan apa-apa rawatan ke atas pesakit. Persoalan yang timbul ialah bagaimanakah doktor hendak mendapatkan keizinan pesakit apabila pesakit sudah hilang keupayaan dan tidak berkeupayaan untuk memberi keizinan? Dalam konteks ini, arahan awal perubatan (advance medical directive) (AMD) yang mengandungi kehendak pesakit tentang pelan perubatan masa depannya boleh memainkan peranan seandainya pesakit sudah hilang keupayaan membuat keputusan tentang tubuh badannya. AMD merupakan satu kaedah penting untuk melindungi hak pesakit apabila pesakit tidak dapat membuat keputusan ketika di ambang kematian. Jika dilihat daripada perspektif Syariah, terdapat satu kemestian (wajib) untuk menjaga nyawa setiap individu. Ini kerana kehidupan manusia bukanlah sia-sia. Namun, tanggungjawab untuk memanjangkan nyawa pesakit yang berada di ambang maut tanpa menyembuhkannya turut perlu diambil kira. Jawatankuasa Fatwa Majlis Kebangsaan bagi Hal Ehwal Agama Islam Malaysia berpendapat bahawa menamatkan hidup seseorang sebelum pesakit tersebut disahkan mati melalui apa-apa cara dan bersandarkan pada apa-apa alasan jua adalah haram dan dilarang dalam Islam. Oleh itu, artikel ini bertujuan membincangkan tentang AMD di Malaysia dari sudut hukum Syariah. Artikel ini akan memberikan gambaran keseluruhan tentang hak pesakit berhubung dengan AMD di Malaysia berdasarkan perspektif Syariah. Bagi tujuan ini, kaedah yang berbentuk kualitatif digunakan dalam artikel ini.
