    THE OMBUDSMAN FOR FINANCIAL SERVICES IN MALAYSIA

    The establishment of the new financial ombudsman scheme is timely and approved by Bank Negara Malaysia (CBM) under the Islamic Financial Services Act 2013 (IFSA) to provide a fair and efficient avenue for financial consumers to resolve disputes against financial service providers since 1 October 2016.

    The Ombudsman for Financial Services serves as an independent redress mechanism with minimum formality for financial consumers to resolve disputes with financial service providers. Its services are an alternative to, and not a replacement for legal actions taken in a court of law. The services of the Ombudsman for Financial Services are offered free of charge to financial consumers.

    THE ROLE OF COURTS AND TRIBUNALS IN LITIGATING ENVIRONMENTAL DISPUTES

    Abstract

    The development of environmental litigation is one that has been fraught with challenges and problems. The role of courts and tribunals in the development of environmental law cannot be over-emphasised, yet the current legal order of environmental litigation has had a negative effect on the progressive development of environmental litigation. The study examines the role of courts and tribunals in the development of environmental law. The study also examines the problems of litigating environmental disputes. The study relies on primary and secondary sources of information. The information obtained through these sources was subjected to content analysis. The study found that there is no particular international court with jurisdiction over environmental disputes where parties can ventilate their grievances. The study recommended the need to modify the existing courts and tribunals and improve the legal framework so that the task of adjudicating environmental disputes would be hitch-free. The study also recommended the establishment of special environmental courts.
