    DISGORGEMENT DAMAGES FOR BREACH OF CONTRACTS: SOMETHING NEW?

    Abstract

    This paper examines the disgorgement remedy against the remedial framework of contractual remedies. First, the paper discusses the circumstances leading to the award of disgorgement remedy for breach of contract. Then, the paper argues that on the surface, disgorgement damages for breach of contract may appear inconsistent with the remedial goal of contractual remedies. Nonetheless, closer examination of the notion of contractual performance demonstrates that disgorgement remedy is consistent with the principles of corrective justice. This paper argues that disgorgement damages for breaches of contract is consistent in vindicating the plaintiff's right towards the defendant's performance of a contract. Such damages encourage performance of a contract at a broader societal level and are thus consistent with the principles of corrective justice.

    PEMBUBARAN PERKAHWINAN MENURUT ENAKMEN UNDANG-UNDANG KELUARGA ISLAM NEGERI MELAKA 2002

    Abstrak

    Pembubaran perkahwinan merupakan salah satu kaedah penceraian yang dibenarkan oleh Enakmen Undang-Undang Keluarga Islam Negeri Melaka dan mesti mengikut prosedur yang telah ditetapkan oleh enakmen tersebut. Pembubaran sesuatu perkahwinan itu tidak boleh berlaku dengan begitu mudah melainkan ada sebab-sebab tertentu yang membolehkannya berbuat demikian. Ini kerana perkara yang harus tetapi dibenci oleh Allah adalah pembubaran perkahwinan, antaranya penceraian. Menurut enakmen ini, proses penceraian mesti mematuhi peruntukan undang-undang yang telah ditetapkan. Tujuannya bagi memastikan segala proses untuk penceraian dapat dilaksanakan mengikut kaedah undang-undang bagi memberikan keadilan dan kebaikan terhadap pihak suami, isteri dan anak-anak serta kesan yang timbul dari pembubaran perkahwinan itu. Kertas kerja ini akan mengkaji beberapa prosedur atau peruntukan undang-undang berkaitan pembubaran perkahwinan yang dilaksanakan menurut Enakmen Undang-undang Keluarga Islam Negeri Melaka 2002 dan kesan yang timbul akibat pembubaran tersebut.
