ABSTRAK

Tanah merupakan satu aset yang penting dan diberi milik oleh kerajaan melalui cara-cara tertentu. Kerajaan berhak mengambil semula tanah yang diberi milik bagi tujuan-tujuan yang benefisial untuk kemajuan ekonomi di Malaysia. Perlembagaan Persekutuan berperanan untuk menjamin hak asasi manusia berkenaan harta. Pengambilan tanah tanpa asas undang-undang merupakan pelanggaran hak asasi tersebut. Objektif kajian ini adalah untuk mengenal pasti samada Pihak Berkuasa Negeri yang diberi kuasa untuk mengambil mana-mana tanah yang diperlukan mematuhi dan mengamal secara teori dan praktikal peruntukan perundangan pengambilan tanah. Kajian ini telah dibuat dengan pembacaan dan pengumpulan data daripada sumber rujukan seperti buku, tulisan ilmiah dan juga rujukan melalui internet. Dapat dirumuskan bahawa kesilapan mengenai prosedur pengambilan tanah sering disebabkan oleh kecuaian pihak berkuasa seperti Pihak Berkuasa Negeri dalam mematuhi prosedur yang telah ditetapkan mengikut undang-undang. Kesannya, sekiranya tiada tindakan yang segera diambil, maka banyak isu-isu yang akan timbul berikutan pengambilan tanah di Malaysia.

The pace of judicial reform will accelerate during 2017. We will hear more about online dispute resolution, virtual hearings and the adoption of digital processes as part of a common platform. Similar technologies have been changing the world in which we live for several years. We have, by and large, become used to them. But have we properly understood their transformative nature? These technologies have an impact on us not just as judges, but as citizens, parents, voters, workers and consumers.

Cast your minds back a decade. Perhaps 2007 does not seem so very long ago. In technological terms, however, 2007 was a lifetime ago. As that year began, no one in the UK had a Facebook account (Facebook launched in the UK in July 2007) and no one in the UK owned an iPhone (Apple launched the first iPhone in the UK in November 2007).

VICTIM IMPACT STATEMENT IN CRIMINAL SENTENCING: SUCCESS OR SETBACK FOR THE CRIMINAL JUSTICE PROCESS?

Abstract:

Given that the commission of a crime is regarded as a commission of an offence against the 'state', criminal cases have often been regarded as mere contests between the prosecutor as the representative of the state, and the accused persons as the perpetrator of the crime. The actual party that suffered due to the crime committed by the accused, namely, the victim of the crime played a rather insignificant role in the imposition of punishment upon the accused. Recent reforms have however revitalised the rights and interests of criminal victims during the sentencing process, and this has led to various developments in the criminal justice system, with the aim of fundamentally integrating the victims into the criminal justice process. This article examines the definition and concept of victim impact statement, its origin, its pros and cons and the Malaysian experience in the implementation of this right. But most importantly, it conceptually analyses the overall implications of the use of the victim impact statement in the criminal sentencing process and the crucial question of whether its implementation unjustly affect the rights of the accused person as the defendant in a criminal proceeding.
