    ABSTRAK

    Malaysia telah memperkenalkan Program Imunisasi Kebangsaan untuk mencegah dan mengurangkan penyakit berjangkit dalam kalangan kanak-kanak di Malaysia. Namun begitu, terdapat segelintir ibu bapa enggan mengizinkan anak mereka divaksinasikan. Kes ibu bapa menolak vaksinasi kanak-kanak semakin hari semakin meningkat dan keadaan ini menyebabkan penularan penyakit berjangkit dalam kalangan kanak-kanak. Artikel ini bertujuan untuk mengenal pasti sebab-sebab ibu bapa menolak pemberian vaksin di Malaysia. Selain dari itu, artikel ini juga akan mengkaji sama ada terdapat undang-undang di Malaysia yang dapat menangani masalah keengganan ibu bapa untuk membenarkan anak mereka divaksinasikan. Maka dalam artikel ini penulis akan menganalisis secara umum undang-undang yang terdapat di Malaysia yang relevan dengan isu vaksinasi kanak-kanak. Penulisan ini mendapati bahawa tidak terdapat undang-undang yang khusus yang menetapkan vaksinasi kanak-kanak sebagai suatu yang wajib di sisi undang-undang.

    "The issue of costs is central to essentially all forms of legal practice."[1] - GE Dal Pont, Law of Costs.

    It is a common (though perhaps dangerous) assumption that a successful party to litigation will obtain an order that the unsuccessful party pay their costs on a party/party basis.[2]

    This is traditionally known as 'costs following the event', with the 'party/ party' component of a costs order usually amounting to about 70 per cent of a party's actually incurred costs.

    However, the ACT Court of Appeal's recent decision in Cooper v. Singh[3] provides a useful reminder that the awarding of costs is an entirely discretionary power that courts may exercise as they see fit.
