EXAMINING ISSUES RELATING TO THE CONTRACTUAL RELATIONSHIP OF DRIVERS IN THE TRANSPORT SERVICE

Introduction

The task of a driver is not an easy task. While operating the vehicle entrusted to them, they must always be vigilant so as to avoid mishap on the road. Their role is undeniably important as without their services, society or the country for that matter, cannot function properly. This is evident as transportation services fall within the ambit of Essential Services under the First Schedule of the Industrial Relations Act 1967.^[1] The Employment Act 1955 (herein after referred to as "the Act") also categorises their function under the First Schedule.^[2] Even so, they are still exposed to uncertainties in their contractual relationship which may lead to labour exploitation. Thus, this article is written with the aim of examining issues relevant to this type of occupation from the perspective of employment law.

APPRAISAL OF THE LEGAL FRAMEWORK FOR THE TREATMENT OF JUVENILE OFFENDERS IN NIGERIA

ABSTRACT

In Nigeria, restorative justice appears to be a myth for those who find themselves at the end of the tunnels of Nigerian prisons. It is almost clear that the Nigerian system is designed for a retributive justice system that does not see any flicker of hope for rehabilitation and recovery of the convicts. The society has practically designed itself to block off any form of reintegration of ex-convicts into the society and this has defeated the mantra of making better lives for the prisoners who find themselves in such situations.

The juvenile offender in Nigeria is treated almost the same way as the adult offenders. These juvenile offenders, identified as young people under the age of eighteen are not incarcerated as their adult contemporaries, but are drafted into a "milder" prison system called the borstal homes. The aim of this paper is to develop on the existing literature on the framework provided for the treatment of juvenile offenders under the Nigerian legal system.
