    Abstract

    In 2002, Netherlands became the first country in the world to legalize both euthanasia and assisted suicide. Prior to this period there have been high profile cases brought to court which equally led to series of pronouncements and guidelines by the Dutch Royal Medical Association. The immediate cause of the legalization can be attributed to the Remmelink Commission which found out that several persons are being euthanized in the Netherlands without their consent. The paper examines the euthanasia of an 80 year old woman through the court in spite of the refusal of the woman's treating doctor whose report gave the woman a clean bill and to show that the refusal to follow the doctor's consent runs contrary to the Dutch (Netherlands) euthanasia and assisted suicide laws. The paper also examines the Dutch (Netherlands) euthanasia and assisted suicide laws alongside that of Belgium; current arguments for and against the concept; views expressed by stake-holders; reports of euthanasia and assisted suicide practices in the Netherlands since 2002, when the concept was legalized in the country. The paper found that practices of euthanasia and assisted suicide under the Dutch (Netherlands) euthanasia and assisted suicide laws were carried out outside the existing or establishing laws coupled with the fact that such practices are rarely reported. Countries and jurisdiction without any specific law on euthanasia and/or assisted suicide should tighten their laws and turn their backs on legalization as practices under the Dutch (Netherlands) euthanasia and assisted suicide laws have shown that it will always be abused. This paper recommends that Dutch (Netherlands) euthanasia and assisted suicide law is not a model to be adopted, rather efforts should be geared at providing adequate palliative and hospice care to terminally ill and vulnerable people since euthanasia and/or assisted suicide is majorly caused by the fear of abandonment by loved ones.

    DANGEROUS DOGS: A HUMAN PROBLEM*

    When it comes to legislating against dog attacks, the focus should be on dog owners, not dogs. It is the attitude of the owner rather than the dog's behaviour, breed, or temperament that most strongly influences whether a dog is likely to be involved in an attack.


    Dog attacks in the community often evoke an emotional response from members of the public and politicians alike. For example, in Victoria in 2011, following the tragic death of Ayen Chol, the government brought forward proposed legislation with more severe restrictions on American pit bull terriers and crosses, purportedly in an attempt to lessen dog attacks in the community.

    This legislation was doomed to fail from the outset, as breed-specific legislation fails to take into account the fact that any breed of dog can be dangerous in the hands of an irresponsible dog owner.
