    THE ROLE OF PUNISHMENT UNDER ISLAMIC JURISPRUDENCE

    INTRODUCTION

    Punishment as the word connotes can be defined to mean sufferness for an offence committed. The Oxford Learner's Dictionary[1] defines punishment to mean "an act or a way of punishing somebody".

    Punishment under the Islamic jurisprudence cannot be compared with what obtains under the English Common Law. The Islamic Law understanding of punishment is for the reformation of the society, the upliftment of the individual from darkness to the way of Allah. Punishment as the word implies, does not under Islam mean "to mete out" but to bring the culprit to understand the doing of good and to do away with evil deeds or behavior.

    RIGHTS OF MIGRANT WORKERS: ACCESS TO JUSTICE

    Introduction

    Malaysia is a developing nation which relies heavily on migrant workers, especially when it comes to the 3D sectors (Dirty, Dangerous and Difficult). Locals are often not inclined to be involved in such work and prefer a more conducive working environment with higher pay. As a result, the nation brings in foreign workers from Bangladesh, India, Pakistan, Vietnam, Thailand, Cambodia, Nepal etc to work in the given sectors. Among the sectors that require foreign labor are construction, sanitary, domestic services, etc.[1] These are sectors that require long working hours and hard physical labor but provide low wages. Many of those in these sectors receive a salary of between RM1200-RM1600 which may not be sufficient for the workers.[2]

    In regards to migrant workers in Malaysia, the work permit is tied to a single employer, and it is common for employers to withhold the passports of workers. This is deemed to be problematic as they have no option but to work for that single employer even if the worker finds it difficult to deal with them. The fact that the passport is withheld by the employer result in workers becoming victims of harassment by the authorities when documents are not in their posession. They are extorted for cash or in a worse-case scenario, are deported to their home country.[3] In the event the worker is abused, there are avenues for legal redress but it is a long process and not without flaws.
