    LAW OF REMAND IN MALAYSIA: RECENT DEVELOPMENTS AND CONCERNS

    The law governing remand procedure in Malaysia is statutorily embodied in section 117 of the Criminal Procedure Code and has further been developed by judicial precedents over the years. This article shall recapitulate the remand procedure as provided for under the law together with the recent judicial pronouncements relating to this subject matter and certain issues of concern in the remand proceedings.

    Since section 117 is the empowering section which allows for remand to take place, it is imperative to reproduce the said section here, whereby it provides for the following:-

    117. Procedure where investigation cannot be completed within twenty-four hours

    (1) Whenever any person is arrested and detained in custody and it appears that the investigation cannot be completed within the period of twenty-four hours fixed by section 28 and there are grounds for believing that the accusation or information is well founded the police officer making the investigation shall immediately transmit to a Magistrate a copy of the entries in the diary hereinafter prescribed relating to the case and shall at the same time produce the accused before the Magistrate.

    THE RECEPTION AND APPLICATION OF ENGLISH LAW IN MALAYSIA

    Introduction

    The Civil Law Act 1956 (Revised 1972) provides for the application of English law in Malaysia on different cut-off dates for West Malaysia, Sabah and Sarawak respectively. In 1971, the Civil Law Ordinance 1956 which was only applicable in West Malaysia was extended to Sabah and Sarawak vide the Civil Law (Extension) Order 1971. Despite this, Sabah and Sarawak still have their own respective legislation on the application of English law i.e. the Application of Laws Ordinance 1951 in Sabah and the Application of Laws Ordinance 1949 in Sarawak. This article traces the roots, and (not so) humble beginnings of the provisions dealing with the application of English law in Malaysia in the Civil Law Act 1956, the differences in its application between East and West Malaysia, and whether the Application of Laws Ordinances in East Malaysia are still relevant or have been rendered redundant by the revision of the Civil Law Act 1956 in 1972.

    FREEDOM OF SPEECH: AN INDISPENSABLE ASPECT OF DEMOCRACY

    ABSTRACT

    Different types of rulers, dictators, tyrants, political opportunists, etc. abound all over the world and in Africa they are not in want. For the people to stand their ground against such rulers largely depends on the availability of a courageous and an impartial citizenry/mass media which is capable of keeping government under check by making it accountable for all political performance. A free speech and press regime is necessary to attain this goal. Freedom of speech is a sine qua non for any democracy to thrive. This article examines the freedoms of speech and the press as they obtain in Nigeria, against the background of a proposal for a hate speech law. It however, focuses more on the freedom of speech. The author concludes that the freedoms, as they currently obtain, need to be promoted and even enhanced for the greater good.
