    ABSTRAK

    Pengakuan (admission) dan pengakuan salah (confession) merupakan keterangan yang relevan untuk dikemukakan dalam sesuatu kes di mahkamah. Walau bagaimanapun, keterangan pengakuan salah mempunyai skop pemakaian yang lebih terhad berbanding dengan keterangan pengakuan. Hal ini kerana keterangan pengakuan salah hanya boleh diberikan oleh tertuduh dalam suatu kes jenayah. Selain tertuduh, orang lain tidak boleh memberikan keterangan pengakuan salah. Dalam suatu kes apabila tiada keterangan lain yang boleh membantu dalam pensabitan tertuduh, keterangan pengakuan salah oleh tertuduh dapat dijadikan asas yang kuat untuk mensabitkan tertuduh kerana nilai probatifnya yang tinggi. Sungguhpun demikian, dalam keadaan tertentu, adakalanya tertuduh cuba untuk menarik semula pengakuan salah yang telah dibuat.

    ISLAM, SCIENCE AND THE MAQASID (HIGHER PURPOSES) OF SHARIAH*

    Maqasid refer to the higher purposes of Shariah, the benefits that the Lawgiver intended and the wisdom He envisaged in validating them in the first place. Many have argued that the Shariah is from beginning to end meant to promote human welfare and benefits, which are however beyond enumeration and too many to recount. Muslim scholars have nevertheless identified certain types of maqasid and classified them from different perspectives. Some of the maqasid, especially in the daruriyyat (essential maqasid) category, are taken from a general reading of the Qur'an and Sunnah and are therefore textually based. The maqasid daruri, or daruriyyat, refer to the essential goals and purposes of Shariah, which are five, and according to a variant reading, six: protection of life, faith, intellect, property, and lineage. A minority opinion adds protection of honour to this list.
