    IN THIS ARTICLE, SIM SOOK ENG CONSIDERS THE CASE OF MUNCHY FOOD INDUSTRIES SDN BHD v. HUASIN FOOD INDUSTRIES SDN BHD.

    Introduction

    This case raised a few important and novel issues that dealt with the locus standi of an aggrieved person, Internet searches as evidence for use of a trade mark and the role of a sub-brand as a source identifier when used together with a house brand.

    The plaintiff in the case, Munchy Food Industries Sdn Bhd ("Munchy Food"), commenced an action against the defendant, Huasin Food Industries Sdn Bhd ("Huasin Food"), for trade mark infringement and passing-off. The basis of Munchy Food's claim surrounded its rights to the trade mark LEXUS used together with a distinctive get-up in relation to its biscuits products.

    Pengenalan

    Tuntutan untuk mendapatkan sebahagian harta sepencarian pada mulanya didasarkan atas adat Melayu dan tuntutan ini boleh dibuat di Mahkamah Sivil dan juga di Mahkamah Syariah di mana Mahkamah Sivil sendiri telah memutuskan bahawa hak itu adalah muncul dari adat Melayu seperti yang dilaporkan dalam kes-kes terdahulu dalam Ramah lwn. Laton,[1] Boto’ bte Taha lwn. Jaafar[2] dan lain-lain. Namun begitu, menurut Ahmad Ibrahim di dalam bukunya, Undang-Undang Keluarga Islam di Malaysia,[3] menyebutkan bahawa pada masa sekarang nampaknya tuntutan harta sepencarian hanya boleh dibawa di Mahkamah Syariah setelah berlaku pindaan kepada Perkara 121 Perlembagaan Persekutuan, yang memperuntukkan bahawa Mahkamah Tinggi Sivil dan mahkamah-mahkamah di bawahnya tidak mempunyai bidangkuasa dalam mana-mana perkara yang termaktub dalam bidangkuasa Mahkamah Syariah.[4] Penulisan ini akan memberi penumpuan kepada konsep dan amalan tuntutan harta sepencarian di Mahkamah Syariah di Malaysia.

    It's scary to think that the legal industry may one day be run by Artificial Intelligence. Although total AI disruption is still a way off, Industry 4.0 is coming.[1] Unless human lawyers learn to adapt and compete, it's only a matter of time before all our clients are signing up with machines.


    AI in the legal industry means the use of intelligent software to optimise the delivery of legal services.[2]

    For example, when the Panama Papers investigation commenced, there were 2.6 terabytes of data (11.5 million documents) to be sorted and analysed. Traditionally this type of work would have been conducted by junior lawyers and paralegals, over thousands of hours. Instead, a powerful data analytics system made it possible for journalists at German newspaper Sueddeutsche Zeitung and the International Consortium of Investigative Journalists (ICIJ) to churn their way through the maze of documents in a fraction of the time (and consequently, a fraction of the cost).[3] As a result, it is not surprising that systems such as Lex Machina by LexisNexis have gained so much popularity in recent years. [4]
