    LAND LAW - INDEFEASIBILITY: MEANING OF 'GOOD FAITH'

    Introduction

    In Peninsular Malaysia, the law governing land matters is embodied in the National Land Code 1965 ("NLC"). The NLC provides for the Torrens system of title by registration - it is the act of registration that confers title to or interest in land.[1]

    Section 340 of the NLC deals with the indefeasibility of a registered title to and interest in land. The term 'indefeasible' though used in Section 340 of the NLC, is not defined in the NLC. By a judge-made decision, this term 'indefeasible' has been judicially defined to mean 'immune from attack by adverse claim to the land or interest in respect of which he is registered'.[2]

    CONFLICT OF INTEREST AND THE REMOVAL OF LIQUIDATORS*

    DIANA LAU ANN NA**

    A liquidator is appointed for the winding up of a company, whether it is a compulsory winding up by the court,[1] or a winding up initiated by its members[2] or creditors.[3]

    The liquidator's primary task is to wind up the affairs of the company and to distribute its assets to the parties interested in the winding up.[4] In performing his duty, the liquidator will:

    (a) Investigate the affairs and assets of the company;

    (b) Investigate the conduct of its directors and other related persons;

    (c) Investigate claims made by creditors and third parties;

    (d) Realise the assets of the company assets;

    (e) Distribute the proceeds of the liquidation to creditors and contributories.[5]

    Perkembangan bidang sains forensik dilihat memberikan manfaat yang amat penting dan besar dalam menyelesaikan atau merungkai misteri dalam sesuatu kejadian jenayah. Bidang ini semakin popular kerana peranannya dalam membantu memberikan jawapan yang hampir tepat dalam siasatan kes. Bidang sains forensik ialah suatu bidang yang menggunakan kepakaran sains dalam bidang fizik, kimia, biologi, sains komputer, kejuruteraan dan lain-lain untuk membantu pihak berwajib dalam siasatan kes. Bidang ini juga memainkan peranan yang penting dalam sistem perundangan jenayah kerana kepakaran tersebut boleh membantu dalam memberikan maklumat saintifik melalui analisis bahan bukti fizikal. Dalam siasatan sesuatu kes, pasukan forensik biasanya perlu mengambil kira pelbagai aspek dalam menjalankan siasatan di tempat kejadian jenayah.

    APPRAISING THE STATUTORY FRAMEWORK ON CHILD RIGHTS PROTECTION

    Abstract

    Children are the future of any family, society or country. To this extent, it is the duty of every government and society to ensure that children are given every care, help, protection, training and education they may need, in order to grow into useful citizens and members of society. It is for this reason that laws have been enacted to protect children from different types of violence. This research paper is an appraisal of the laws put in place by the Nigerian government to protect children from violence and abuse. The thrust of this paper shall be to first expound the theory of who a child is and the position of the law with regards to the right of a child in the home and society at large. Furthermore, this work examines the legal concept of a child and the provisions of the law, geared towards protection of the child. It also seeks to make an assessment/examination as to whether those provisions are adequate or not. This paper concludes that there is a need to ensure enforcement of these laws so that the Nigerian child can be protected from all types of violence.

    Abstrak

    Dewasa ini, terdapat banyak insiden kebakaran yang berlaku di negara kita. Ia berlaku disebabkan oleh pelbagai faktor seperti kerosakan peralatan elektrik, renjatan kuasa dan sebahagiannya disebabkan oleh perbuatan khianat menggunakan api. Oleh yang demikian, penyiasatan kebakaran adalah sangat penting bagi memastikan punca-punca kebakaran dapat dikenal pasti. Secara umumnya, penulisan ini akan membincangkan siasatan kebakaran di negara ini serta peranan yang dimainkan oleh pegawai penyiasat kebakaran. Penulisan ini juga meninjau cabaran-cabaran yang dihadapi oleh pegawai penyiasat kebakaran di Malaysia. Penulisan ini meneliti amalan siasatan kebakaran di negara lain dan membuat perbandingan dengan amalan yang diterima pakai di Malaysia. Ini bertujuan mengenal pasti kelemahan-kelemahan yang terdapat dalam siasatan kebakaran di Malaysia agar mutu penyiasatan bertambah baik pada masa akan datang.
