    Introduction

    The problem of fugitive criminals who evade arrest by escaping to other jurisdictions has been a perennial thorn in the side of law enforcement, especially in light of the various transnational crimes being committed such as money-laundering, drug trafficking and modern slavery. Thus, in order to ensure that countries do not become havens from justice, the process of extradition has been carefully crafted to resolve this issue. This form of international cooperation, elegant in its simplicity, involves fugitive criminals, or those accused of crimes, being sent by their host country back to the country where the crime was allegedly committed in order to face trial or serve their sentence in that jurisdiction. As expressed by the Supreme Court of Canada in Kindler v. Canada (Minister of Justice)[1] and quoted by our Federal Court in Said Mir Bahrami v. Pengarah Penjara Sungai Buloh, Selangor, it is a system "founded on concepts of comity and reciprocity"[2] between different sovereign nations.

    CUSTODY AND RELIGION OF MINORS IN MALAYSIA*

    Child custody refers to the upbringing of children which includes the responsibility to provide protection, love, care, education, shelter and guidance to the child. Generally, in determining the legal custodian of a child, the court will first and foremost ensure that the child's welfare is well-protected.

    In Malaysia however, child custody is governed by separate laws for non-Muslims and Muslims. For non-Muslims, it is the Law Reform (Marriage and Divorce) Act of 1976 (Act 164), while for Muslims, they are the Islamic Family Law Enactments (of the respective states) and the Islamic Family Law Act for Federal Territories. The Malaysian civil court administers the former, while the Syariah court applies the latter.

    How Australia's migration system deals with disability

    An under-discussed feature of Australia's migration system is its problematic treatment of visa applicants with disabilities. Australia's Disability Discrimination Act aims to protect individuals from unfair treatment on the grounds of their disability, however, this does not extend to those seeking certain visas in Australia.


    At present, to be granted certain visas (such as permanent residency visas), the Migration Regulations 1994 prescribe a number of "Public Interest Criteria" (PIC) that must be satisfied by both the applicant and any family members migrating with them.

    PIC 4005 and 4007 stipulate that the visa applicants must be free from a disease or condition, in relation to which the provision of the health care or community services would be likely to:

    (a) Result in a significant cost to the Australian community in the areas of health care and community services or

    (b) Prejudice the access of an Australian citizen or permanent resident to health care or community services.
