    Abstrak

    Kriminologi merupakan satu bidang yang telah lama digunakan dalam penyiasatan dan penyelesaian kes-kes jenayah di persada dunia. Bidang ini semakin berkembang dari semasa ke semasa sehingga penggunaannya semakin meluas dalam sistem keadilan jenayah. Namun begitu, persoalan berbangkit tentang sejauh manakah bidang kriminologi berperanan dalam penyiasatan jenayah dan apakah cabaran yang dihadapi oleh bidang ini. Penulisan ini bertujuan mengenal pasti peranan yang dimainkan oleh bidang kriminologi dalam penyiasatan kes-kes jenayah di samping meneliti cabaran atau kekangan yang dihadapi oleh bidang ini di Malaysia. Selain itu, penulisan ini juga menggariskan beberapa cadangan untuk menambah baik peranan bidang kriminologi dalam sistem keadilan jenayah di Malaysia. Sesungguhnya, bidang kriminologi ini memainkan peranan yang cukup signifikan dalam penyiasatan dan penyelesaian kes-kes jenayah.

    A CRITICAL ANALYSIS INTO THE REALM OF CHICAGO CONVENTION 1944 AND ITS ANNEX 17

    ABSTRACT

    Protection of civil aviation against any of the man-made unforeseen circumstances is generally of two kinds viz; safety, and security of aircraft. While safety relates to the engineering aspect of civil aviation, security is an aspect whereby civil aviation is protected against any of the unlawful interferences which include hijacking, sabotage of aircraft, airport destruction and hostage of passengers among others. The safety aspect is outside the scope of this paper. The International Civil Aviation Organization (ICAO) has adopted the Chicago Convention 1944 and its Annex 17 to prevent and suppress any act of unlawful interference. These provisions contain useful security rules and procedures that should be followed by the airport and aircraft operators, throughout the world. It is on this that the paper critically examines these security documents with a view to knowing the challenges in their adoption. The paper adopts a qualitative method of legal research consisting of sourcing data from the library and conducting of interview from the aviation security stakeholders. The paper finds that challenges such as high cost of aviation security equipment, lack of expertise in the field of aviation security, and improper implementation of aviation security and directive greatly contribute to the insecurity of civil aviation in the 21st century. It therefore recommends that civil aviation deserves serious attention by way of provision of funds, sending staff for refresher courses and appointment of aviation security experts to manage the security aspect of both airport and aircraft.
