    MENTAL HEALTH LAW DEVELOPMENT IN MALAYSIA

    Abstract:

    This study aims to trace the development of mental health laws in Malaysia since the early 1900s. This will include legislations and policy, namely; the Lunatic Ordinance of Sabah 1951, Mental Disorders Ordinance 1952, Mental Health Ordinance of Sarawak 1961, Mental Health Act 2001 and National Mental Health Policy 1997. This study reveals that Malaysian mental health laws have undergone major developments throughout the years. The current Mental Health Act 2001 is more comprehensive as compared to the previous Ordinances in addressing several issues such as applicability of the law throughout Malaysia, delivery of health services and the rights of mentally disordered persons. Furthermore, this study analyses several international legal instruments involving mental healthcare and the rights of mentally disordered persons which Malaysia adhered to. It is found that Malaysia has manifested its commitment under the international legal instruments through local legislations such as the Mental Health Act 2001 and Persons with Disabilities Act 2008. In addition, the rights of mentally disordered persons are also guaranteed under the Malaysian Federal Constitution.

    ABSTRAK

    Perjanjian Perkongsian Trans-Pasifik (TPPA) merupakan satu perjanjian perdagangan baru yang dilihat sebagai perjanjian ulung yang bakal membawa perubahan besar kepada negara dalam pelbagai sektor khususnya perdagangan dan ekonomi. Perjanjian perdagangan ini bukan sahaja menyentuh isu perdagangan tetapi turut menyentuh banyak aspek lain seperti piawaian buruh, alam sekitar dan harta intelek. Persoalannya ialah bagaimana dengan kelangsungan undang-undang buruh di Malaysia dalam menepati Bab Buruh seperti yang diperuntukkan di bawah TPPA? Adakah Malaysia perlu mengekalkan sistem buruh sedia dengan sedikit pindaan ataupun perlu kepada transformasi besar bagi merealisasikan keberkesanan TPPA? Metodologi kajian yang digunakan adalah analisis teori berdasarkan data yang diterbitkan secara sumber primer dan sekunder. Artikel ini bertujuan untuk menganalisis implikasi perundangan buruh di Malaysia setelah Malaysia menandatangani TPPA yang turut disertai oleh 11 buah negara lain. Dapatan awal kajian menunjukkan bahawa beberapa undang-undang buruh di Malaysia perlu dipinda sebagai memenuhi obligasi pematuhan kepada piawaian buruh antarabangsa seperti yang ditetapkan di bawah TPPA.

    Introduction

    Travel and tourism remain a highly lucrative industry for the South East Asian ("SEA") Region in 2018 with statistics from the World Travel & Tourism Council showing direct contribution from the industry in SEA to be USD 135.8 billion in 2018 alone, with this number forecasted to rise by 5.9% in 2018, and to rise by 5.5% per annum in the next decade.[1] Malaysia continues to be a highly rated destination in Asia with the country receiving a sizeable slice of the tourism pie every year. In 2017, the country ranked 3rd in Asia by number of arrivals[2] with RM 82.1 billion in receipts from 25.9 million arrivals.[3]

    With such significant annual numbers in tourist arrivals, it had become increasingly important for Malaysia to weigh between countervailing policy considerations. On one hand, the imposition of the RM 10 tourism tax for instance was welcomed by some quarters as the revenue collected could be used toward the maintenance of tourism infrastructure as well as for promotion and marketing purposes. On the other hand, competition in the SEA tourism market remains tough and excessive capitalisation of foreign tourists could be seen as harmful towards the tourism industry.

    There has been a change in the principal outlet through which opinions and ideas are expressed in our society. It is a quantum shift from the printed media to the preferred outlets on the internet. Websites and blogs are self-created and, unlike the printed media like newspapers, do not require editorial sanction. A symptom of the increased reliance on the online media outlets has been the surge in the number of defamation actions filed in respect of internet postings. The introduction of section 114A of the Evidence Act 1950 has had a marked impact in this area and, thereby, the right to free expression in our country. This article proposes to examine this impact of the new provision.
