The expanding contours of religion in society potentially challenge the adequacy of freedom of religion as a constitutional framework to protect religious belief. Indeed, protecting religious freedom through the law has a certain paradox to it, for while it protects the autonomy of individual religious beliefs, the law nevertheless arrogates to itself the exclusive right to define what is and what is not "religion".

In Malaysia, the Federal Court in different cases has held, among others, that wearing the niqab (face veil) is not required in Islam (Meor Atiqurrahman), that wearing the turban is not obligatory in Islam (Halimatussaadiah), and that Islam means more than just rituals (Lina Joy). In jurisdictions expressly declaring themselves to be secular, such expansionist role of religion poses considerable challenge in determining where exactly does religion end.

Abstract

The emergence of the Privately Contracted Armed Security Personnel (PCASP) is recognized at the international level in the year of 2010 and 2011 when it was intensely discussed at the International Maritime Organization (IMO) Meetings. The employment of PCASP on board merchant ships is a popular mechanism adapted by shipowners in dealing with the threat of piracy, armed robbery and ship hijacking during voyage. At the international level, the debate is still ongoing on whether the presence of PCASP on board vessels will ensure the safety and security of the ship, crew and cargo or it can lead to escalation of violence and cause harm prejudicial to coastal state peace and security.

THE EXTENSION OF THE MALAYSIAN FEDERAL CONSTITUTION TOWARDS MIGRANT WORKERS IN MALAYSIA, A COMPARISON WITH UK, CANADA, INDIA, GERMANY, SWITZERLAND, ITALY AND REFERENCE TO INTERNATIONAL TREATIES/LAWS

Abstract

The Constitution is Malaysia’s most supreme law, any laws that conflicts is deemed null and void asserts the statement on Constitutional Supremacy.^[1] The Constitution is designed to protect rights and liberties of citizens and these are known as fundamental rights. However, an issue that needs further clarification would be the extension of the Constitution towards non-citizens. By far there has been no binding authority to extend the constitution to non-citizens. In this paper we shall attempt to take this discussion further and with the use of basic legal reasoning added with academic reference, to encompass these fundamental rights to non-citizens who occupy the state. Among the relevant provisions are Article 5 (Fundamental Liberties)^[2], Article 6 (Prevention of Forced Labor)^[3] and Article 8 (Equality)^[4] of the Malaysian Constitution and reference is also made to the Indian Constitution, the Swedish Constitution, the unwritten British Constitution, etc. International treaties such as the International Covenant on Civil and Political Rights 1966 (ICCPR), and the Universal Declaration of Human Rights 1948 (UDHR) is also taken into consideration.
