    Secara asasnya peruntukan seksyen 69A Akta Kerja 1955 (selepas ini dirujuk sebagai "Akta")[1] bertujuan untuk mengelak dari pertindihan prosiding. Dalam hal tersebut, pertindihan prosiding merujuk kepada pertindihan prosiding siasatan Mahkamah Buruh dan prosiding-prosiding di bawah Akta Perhubungan Perusahaan 1967.

    Persoalan pertama yang timbul adalah samada pekerja boleh membuat aduan di bawah Seksyen 69 Akta sedangkan pekerja itu telah mengemukakan representasi di bawah seksyen 20 Akta Perhubungan Perusahaan 1967.[2] Pada hemat saya, Mahkamah Buruh tidak terikat kepada Sekseyn 69A Akta apabila pekerja membuat pengaduan dan memohon remedi yang berkaitan dengan upah bagi kerja yang dilakukan. Selanjutnya, representasi yang dikemukakan di bawah seksyen 20 Akta Perhubungan Perusahaan 1967 berbeza kerana ia tertakluk kepada matlamat pemulihan kerja atau remedi-remedi yang boleh diaward akibat pemecatan salah sekiranya dirujuk ke Mahkamah Perusahaan.

    IN THIS ARTICLE, MICHELLE LOI ANALYSES THE RECENT FEDERAL COURT DECISION ON THE VALUE OF MARKET SURVEYS TO PROVE NON-USE.

    The value of a market survey often used by a "person aggrieved"[1] to challenge a registered trade mark on the ground of non-use was assessed by the Federal Court in the recent case of Liwayway Marketing Corporation v. Oishi Group Public Co Ltd.[2] The Federal Court held that compliance with the Whitford Guidelines[3] does not automatically translate a person aggrieved case into one where the prima facie burden of proving non-use has been discharged.
