    Introduction

    Some may be wondering what a "telekung" is as it is probably not a common term. A Telekung is a Muslim prayer outfit for females. The general perception of prayer outfits is that they are dull and unfashionable as they have to be modest rather than trendy. However, there has been a drastic shift in the fashion industry in recent years where there are an increasing number of fashionable yet modest clothes in both local and international markets.

    The recent High Court case of Siti Khadijah Apparel Sdn Bhd v. Ariani Textiles & Manufacturing (M) Sdn Bhd[1] concerns the telekung sold by the plaintiff, Siti Khadijah Apparel Sdn Bhd (“Siti Khadijah”), and the defendant, Ariani Textiles & Manufacturing (M) Sdn Bhd (“Ariani Textiles”). Siti Khadijah sells the “Telekung Siti Khadijah Klasik” (“Siti Khadijah’s Telekung”) while Ariani Textiles sells the “Ariani x WOW Telekung Nur Aleesya”. Siti Khadijah has commenced an action against Ariani Textiles for copyright infringement.

    In Malaysia, there is a legal requirement that a tauliah (permission) must be sought from the religious authority before someone can preach and disseminate the teachings of Islam. This legal requirement has been justified not only based on the purpose of maintaining public order in the multi-religious society of Malaysia, but some scholars argued that there is an affirmative hadith to validate the imposition of tauliah as a prerequisite before one could teach Islam. Muadh ibnu Jabal reported that when Allah's Messenger sent him to Yemen, the Prophet asked him how would he judge and decide disputes brought to him. Muadh said, "I will judge by Allah's Book." The prophet asked, "What if it is not found in the Book of Allah?" Muadh said, "Then according to the Sunnah of Allah's Messenger". The prophet asked, "And if it is not in the Sunnah of Allah's Messenger?" Muadh said, "I will make ijtihad through my judgment." The Prophet said, "Praise belongs to Allah Who has made the messenger of the Messenger of Allah consistent with what pleases him."

    Pendahuluan

    Beban pembuktian merupakan salah satu aspek terpenting yang mesti dikemukakan dan dibuktikan oleh pihak pendakwa kepada pihak mahkamah bagi menyokong sesuatu dakwaan. Sekiranya pihak pendakwa gagal untuk mengemukakan bukti tersebut menurut prinsip yang telah ditetapkan, bermakna beliau telah gagal untuk membuat tuduhan apatah lagi untuk mensabitkan tuduhan terhadap pihak yang dituduh. Proses membuat dakwaan kepada hakim dan hakim akan mendengar segala dakwaan dan hujah yang dikemukakan kepadanya oleh kedua-dua pihak, kesemuanya akan berjalan berdasarkan kepada kaedah-kaedah atau prinsip-prinsip tertentu yang mesti dipatuhi oleh semua pihak yang terlibat di dalam dakwaan termasuklah hakim.

    Abstrak:

    Undang-undang yang mengawal operasi dalam kewangan Islam telah mengalami banyak perubahan sejajar dengan perkembangan kewangan Islam yang pesat di Malaysia. Ini telah menunjukkan iltizam kerajaan untuk menjadikan Malaysia sebagai Islamic hub di mata dunia. Maka, kertas ini bertujuan untuk mengkaji kerangka undang-undang untuk mengawal perbankan dan kewangan Islam di Malaysia. Penulis akan membincangkan kepentingan penggubalan Akta Bank Negara 2009 dan Akta Perkhidmatan Kewangan Islam 2013 yang menggantikan Akta Bank Negara 1958 dan Akta Bank dan Institusi-Institusi Kewangan 1989 Penggubalan undang-undang yang mantap ini dapat mengawalselia untuk memastikan pematuhan syariah dalam keseluruhan operasi dan aktiviti di institusi perbankan Islam. Seterusnya, kertas ini akan membincangkan undang-undang yang lain untuk mengawal kestabilan kewangan Islam di Malaysia. Di akhir penulisan, penulis akan memberi cadangan yang bernas untuk mengisi kekurangan yang terdapat di undang-undang perbankan dan kewangan Islam.
