    1.0 Introduction

    "Economy is the method by which we prepare today to afford the improvements of tomorrow," said John Calvin Coolidge. As the above mentioned proposition rightly pointed out, an economy is a vast idea that rules the enhancement and development of any nation in the world. Due to its impact and effect on the nation, the backbone of the economy becomes an issue in many jurisdictions. Turkish novelist Mehmet Murat Ildan said succinctly, "While eating a delicious food, remember the peasants and the workers who made this possible!". In other words, workers are the backbone or role players in any economic arena. They are the ones who drive the economic delivery system. For instance, Black Tuesday in 1925 in the United States is a scenario where the economic downturn was in tandem with the dramatic increase in the unemployment rate during that era and makes us realise the nexus between the economy and employees. Thus, in a lexical meaning, economics and employees co-exist and cannot be easily separated.

    Pendahuluan

    Keterangan merupakan sesuatu elemen yang sangat penting untuk dikemukakan di dalam Mahkamah Syariah ataupun Mahkamah Sivil. Dalam sesuatu perbicaraan di Mahkamah Syariah, setiap pihak tidak kira dalam kes mal ataupun jenayah diberi pilihan untuk mengemukakan bukti-bukti yang terdiri dari pelbagai jenis atau kaedah antaranya pengakuan (iqrar), penyaksian (shahadah/testimony), keterangan dokumentar (kitabah/documentary evidence), pandangan pakar (ra'yu al-kabir/expert opinion), sumpah (yamin/judicial oath) dan lain-lain. Oleh itu, iqrar atau pengakuan (confession) merupakan salah satu cara keterangan yang boleh diterima di dalam Mahkamah Syariah yang tertakluk kepada syarat-syarat tertentu. Iqrar adalah merupakan salah satu cara pembuktian yang terkuat dalam Hukum Syara'.

    STAY OF PROCEEDINGS IN CRIMINAL TRIALS IN NIGERIA

    ABSTRACT

    Laws are made for man, and not man for the law. Wherever we can be sure that the most valuable interests of a nation require that we should decide one way, that way we ought to decide.[1] This is the equivalent of Jesus's admonition to the Pharisees in the holy Bible, when he said to them 'The Sabbath was made for man, not man for the Sabbath...'[2] Man is fallible, so are the thoughts of man,[3] therefore when a law ceases to serve its purpose it is either amended or repealed. The above axiomatic epigram bears out firmly in this article. It is not in doubt that Courts of Criminal Jurisdiction in Nigeria, be it trial or appellate, are empowered to halt altogether the Prosecution of criminal trials in Nigeria pending the outcome of an expected event in a superior court. These powers are otherwise called 'Stay of Proceedings' and it constitutes a major source of abuse of process in criminal trials in Nigeria.

Maka, kertas ini bertujuan untuk mengkaji kerangka undang-undang untuk mengawal perbankan dan kewangan Islam di Malaysia. Penulis akan membincangkan kepentingan penggubalan Akta Bank Negara 2009 dan Akta Perkhidmatan Kewangan Islam 2013 yang menggantikan Akta Bank Negara 1958 dan Akta Bank dan Institusi-Institusi Kewangan 1989. Penggubalan undang-undang yang mantap ini dapat mengawal selia untuk memastikan pematuhan Syariah dalam keseluruhan operasi dan aktiviti di institusi perbankan Islam. Seterusnya, kertas ini akan membincangkan undang-undang lain yang mengawal kestabilan kewangan Islam di Malaysia.
