    DOES THE JUDICIARY REQUIRE REFORM?

    Introduction

    1. A committee was formed by the government to make recommendations for reforming, inter alia, the Judiciary. This necessarily means the Judiciary has gone off track requiring reformation to set it back on the right path. Therefore it is sine qua non to identify what, if any, really is wrong with the Judiciary. For that you need to know what the Judiciary is supposed to do before you can conclude what action or inaction is considered wrong. This paper pertains to only the High Court which I served from 1 March 1992 until my early retirement 30 November 2008. What I have to say is based primarily on my experience as a judge and in the management of the courts I was put in charge of. This experience is briefly described in my autobiography Justice Encounters.[1] Hopefully, this paper will be of use when considering the reformation of the Judiciary.

    Introduction

    In Peninsular Malaysia, the law governing land matters is embodied in the National Land Code 1965 (“NLC”). The NLC provides for the Torrens system of title by registration - it is the act of registration that confers title to or interest in land.

    According to the NLC (see Section 170 thereof in respect of final title; Section 186 thereof in respect of qualified title), title in continuation is a title issued by the land office/land registry (as the case may be) in the name of the person or body last registered as proprietor in the subsisting register document of title. Register document of title, in layman’s terms, means the records of the land office/land registry.

    Abstract

    Despite their immense contribution towards the establishment of the International Criminal Court (ICC), there is increasing call for African countries to boycott the ICC. This is due to perceived selective judgments meted out to African leaders, which tend to suggest that the ICC is an imperialist tool that is targeting Africa and its political leaders. This perceived undue targeting of African countries by the ICC has led to friction between the Court and the African Union (AU). However, the implications of boycotting the ICC by African countries are unclear. How such action could reshape the international judicial system is uncertain. Therefore, this paper examined the geopolitical dynamics of the ICC prosecutions and its relationship with African countries, in order to determine the implications of African countries boycotting the ICC.
