    TRANSPARENCY OF JUDICIAL PROCEEDINGS: A JUSTIFICATION*

    Open proceedings have become a distinct hallmark of the judicial process. The basis of such phenomenon has been encapsulated in modern terms as a demand of the open justice principle. The principle signifies that members of the public have free access to courts and are entitled to attend and observe any hearing. The principle of open justice does not only allow members of the public to have access to trial but it extends to include the right to report the proceedings. The public in general and the press in particular may freely discuss and publish accounts of court proceedings, hearings and decisions unless the court has ordered otherwise in appropriate circumstances. The commitment to open justice is unique for it is not observed in non-judicial process of disputes settlement. Unlike the judicial process, disputes that are resolved through the non-judicial process may be held secretly far from the knowledge and presence of members of the public because non-judicial process is primarily within the realm of private autonomy. Disputants in the non-judicial proceedings are completely entitled, and in a better position to decide on the mechanism, procedures and terms of the resolution. They may thus keep the process privately to themselves or they may do it in public.

    LEGAL IMPEDIMENTS TO THE PROPOSED CATTLE COLONIES IN NIGERIA

    ABSTRACT

    In response to the frequent clashes between cattle herdsmen and farmers in some parts of the country, the Federal Government of Nigeria has proposed the establishment of cattle colonies across the country. It is believed by the Federal Government that the establishment of the cattle colonies would solve the continued herdsmen/farmers conflict in parts of the country. However, the above Federal Government proposal has been widely resented drawing heavy criticisms from major stakeholders, particularly State Governors, who are the chief custodian of Land in the territory of their respective States in the Country. This paper therefore examined the rationale and the expected benefits from the proposed cattle colonies. The paper particularly discussed the Legal Impediments to cattle proposal and recommended ranching as an alternative to the proposed colonies. Finally, the paper recognized that if the Federal Government would continue to pursue the said proposal on cattle colonies, there is the need for a radical amendment to the extant Laws on Land management and control in Nigeria.
